KBC Minimum Training Service Level Agreement

Service Period: 1st August 2022 – 31st July 2023
Purpose:
The purpose of this agreement is to outline the mutual commitments between Karen Blake Coaching Ltd (KBC) and its clients, ensuring that excellence in service is an integral part of planning, resourcing, and delivering all training services.
Supply of Training for Services
- KBC will perform the services on the dates specified in the schedule or as otherwise agreed upon in writing.
- Services will be conducted at the specified location or at an alternate location agreed upon in writing.
- Clients wishing to modify the number of learners or alter any aspect of the services, including rescheduling, must provide written notice to KBC within 10 working days of the scheduled service date. Failure to do so may result in full invoicing by KBC, regardless of service completion.
Minimum Number of Learners
KBC requires a minimum of four learners for service delivery, as outlined in the schedule or agreed upon in writing. If the client intends to reduce the number of learners, they must notify KBC within 10 working days of the scheduled service date. KBC will invoice for a minimum of four learners.
Learner Behaviour
When providing services to learners, KBC reserves the right to request the removal of a learner due to reasonable grounds, including but not limited to misconduct or displays of abusive and aggressive behaviour. KBC will promptly inform the client of such an event.
Client Obligation
To enable KBC to fulfil its obligations and adhere to the service standards, the client shall:
- Co-operate with KBC.
- Provide KBC with any information reasonably required by KBC.
- Obtain all necessary permissions and consents which may be required before the commencement of the Services and/or provision of the training being provided; and
- Comply with such requirements as may be set out in the Service Specification or description of the Courses, or otherwise agreed between the parties.
The client is liable for compensating KBC for any expenses incurred due to non-compliance with Clause 1.
Eligibility for and Outcome of Training Courses
The client is responsible for ensuring learners are fit for the chosen course/training/workshop and have the capability to handle intensive study. While KBC welcomes students with disabilities, the client’s employer should provide appropriate workplace support. KBC should be notified in advance of any student assistance needs.
If KBC determines that a student hasn’t met course learning outcomes or assessment standards (i.e., they are referred), a reassessment may be offered with potential additional charges. Extra training or coaching beyond the course content may also incur charges.
Learner Commitment
If a learner arrives late or is absent from a session, KBC reserves the right to refuse further training if it deems that the learner won’t gain sufficient knowledge or skill in the remaining time. In such cases, the full learner fee remains payable. Attendance at all sessions is mandatory unless otherwise stated to meet awarding body certification requirements. No award may be granted if all requirements are not met, and the awarding organisation has the right to withhold, withdraw, and deny approval for qualifications. In cases of gross misconduct, outstanding fees become immediately payable to Karen Blake Coaching Ltd.
Tutor/Trainer
If a named Tutor/Trainer is designated for training/workshops, KBC will make reasonable efforts to ensure their availability. If the designated Tutor/Trainer is unavailable, KBC will offer a substitute. If the client declines the substitute, both parties will agree on an alternative date, dependent on the named Tutor/Trainer’s availability. KBC accepts no further liability for Tutor/Trainer unavailability on the course date.
Terms of Payment
Unless otherwise agreed upon, the client shall pay KBC within 30 days of the invoice date. Failure to make timely payment may incur an 8% annual interest charge above Natwest plc’s base rate. The client is not entitled to offset amounts due to KBC, except as agreed or required by law. All course fees are subject to the current VAT rate (valid exemptions only).
Cancellations
Clients must notify KBC of cancellations before the scheduled training/workshop session, as outlined below:
- 6 or more days: None
- 3 – 5 working days: 50% of Course Fee
- Same Day: 100% of Course Fee/Minimum Learner rate
For learners eligible for funding, a £125 cancellation fee applies if they enrol and fail to complete or withdraw early.
